Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Casa Xubi website at casaxubi.com (the "Site") and the vacation rental services offered by Casa Xubi ("we," "us," or "our"), located on the Ditleff Peninsula, St. John, U.S. Virgin Islands.

By accessing our Site or making a reservation, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Site and book a reservation. By making a booking, you represent that you meet these requirements and that all information you provide is accurate and complete.

Reservations and Bookings

Booking Inquiries

Submitting a booking inquiry through our Site does not guarantee a reservation. All bookings are subject to availability and confirmation by Casa Xubi. A reservation is only confirmed once you receive a written confirmation from us and any required deposits have been received.

Rates and Fees

All rates displayed on the Site are subject to change without notice. The final rate for your stay will be confirmed at the time of booking. Additional fees may apply for services such as concierge arrangements, airport transfers, or special event hosting. Applicable taxes and fees will be disclosed prior to booking confirmation.

Payment

Payment terms, including deposit requirements and accepted payment methods, will be communicated at the time of booking confirmation. Full payment is typically required prior to arrival unless otherwise agreed upon in writing.

Cancellation and Refund Policy

• 30+ days before check-in: Full refund of any deposits paid.
• 15-29 days before check-in: 50% refund of any deposits paid.
• Less than 15 days before check-in: No refund.

All cancellation requests must be submitted in writing to info@casaxubi.com. We reserve the right to cancel a reservation at any time due to unforeseen circumstances such as property damage, natural disasters, or safety concerns. In such cases, a full refund will be provided.

Property Rules and Guest Responsibilities

As a guest of Casa Xubi, you agree to the following:

• Treat the property, furnishings, and amenities with care and respect.
• Occupy the property with no more than the agreed-upon number of guests.
• Comply with all local laws and regulations of the U.S. Virgin Islands.
• Refrain from any activity that may disturb neighbors or damage the property.
• Report any damage, maintenance issues, or safety concerns immediately.
• Leave the property in a reasonably clean and orderly condition upon checkout.

You are responsible for any damage to the property or its contents caused by you or members of your party during your stay, beyond normal wear and tear. We reserve the right to charge for repairs or replacements.

Check-In and Check-Out

Check-in and check-out times will be communicated in your booking confirmation. Early check-in or late check-out requests are subject to availability and may incur additional fees. Failure to check out by the designated time may result in additional charges.

Limitation of Liability

To the fullest extent permitted by law:

• Casa Xubi is not liable for any personal injury, loss, theft, or damage to personal property during your stay, except where caused by our gross negligence.
• We are not responsible for interruptions to services or amenities (including but not limited to power outages, water supply, internet connectivity, or pool/spa equipment) caused by factors beyond our control.
• Our total liability for any claim arising from your use of the Site or your stay shall not exceed the total amount you paid for your reservation.

Guests use all property amenities, including the infinity pool, rooftop terrace, jacuzzi, and beach access, at their own risk.

Assumption of Risk

The property is situated on a tropical island with natural hazards including sun exposure, ocean currents, marine life, uneven terrain, and tropical weather conditions. By booking a stay, you acknowledge these inherent risks and agree that Casa Xubi is not liable for any injury or harm resulting from natural conditions or outdoor activities.

Intellectual Property

All content on our Site, including text, images, logos, graphics, design elements, and photography, is the property of Casa Xubi or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

Acceptable Use of the Site

You agree not to use our Site to:

• Submit false, misleading, or fraudulent booking inquiries or contact form submissions.
• Attempt to gain unauthorized access to any part of the Site or its systems.
• Interfere with or disrupt the operation of the Site.
• Use automated systems (bots, scrapers, etc.) to access or collect data from the Site without permission.

Third-Party Services

Casa Xubi may arrange third-party services on your behalf, including but not limited to transportation, dining reservations, spa treatments, water sports, and guided tours. These services are provided by independent contractors and we are not responsible for their performance, quality, safety, or any resulting claims. Any agreements for such services are between you and the third-party provider.

Force Majeure

Casa Xubi shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, hurricanes, tropical storms, pandemics, government actions, utility failures, or acts of terrorism. In such events, we will work with you to reschedule your stay or provide a refund at our discretion.

Indemnification

You agree to indemnify and hold harmless Casa Xubi, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Site, your stay at the property, your violation of these Terms, or your violation of any rights of a third party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the U.S. Virgin Islands, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of the U.S. Virgin Islands.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
